Professional Referrals – Lasting Powers of Attorney (LPAs)

In an ideal world, everyone would already have Lasting Powers of Attorney in place before they arrive in your care or service. In reality, that is often not the case.

Professionals are often unsure whether LPAs are still possible once capacity is in question. Where someone still has basic mental capacity, it may not be too late to put LPAs in place — even if capacity is fluctuating or support is needed.

Professionals often encounter people who are beginning to struggle with decision-making, communication, or managing their affairs, but who may still retain enough mental capacity to plan ahead.

Where this is the case, early advice about Lasting Powers of Attorney (LPAs) can preserve autonomy, reduce safeguarding concerns, prevent disputes, and avoid unnecessary Court of Protection involvement.

Capacity is decision-specific and time-specific. A diagnosis, vulnerability, or need for care does not automatically mean it is too late.

Referrals are informal, non-pressured, and capacity-led. Each situation is assessed carefully before any documents are prepared.

If LPAs are not appropriate, this will be explained clearly. The aim is to retain control where the law still allows — not to push paperwork.

Referrals are treated as safeguarding-aware discussions, not sales enquiries.
